By using this site, you signify your acceptance of these conditions in return for which we will provide you with access. From time to time we may modify the conditions so please continue to review the conditions of use whenever accessing or using this site.



1. REVISIONS

Gulf Fruit reserves the right to amend/update the terms and conditions here in at its sole discretion without any notice to the Customer.



2. PRICE

2.1 Gulf Fruit reserves all rights to change the price and any content of the website without any prior notice.

2.1 Gulf Fruit reserves the right to adjust the final bill after the on-line bill/order price is presented or conveyed to the customer due to unforeseen circumstances and such adjustments shall be marked on the final bill presented to the customer at the time of delivery.

2.3 Product sizes may vary from the description offered online due to the lead time between changes done by suppliers and updating of the system.

2.4 Online bill and the final bill may vary due to reasons such as Out-of-stock, Special offers, Daily price changes, substitutions of nearest product and items that has price that varies with weight.



3. CHANGES TO ORDER

3.1 Orders can be amended by contacting us over phone (+971 58 105 2395 ) / email ( online@gulffruits.com) and the delivery of the amended items will be supplied along with the present or the next delivery and the prices will be updated consequently.

3.2 After the order is delivered, customers should contact Gulf Fruit within 2 hours for any return/replacement and complaints.

3.3 Any product-related issues should be reported within 2 hrs. post-delivery



4. RETURN & REFUND POLICY

4.1 Refunds are processed on the below scenario:

a. Cancelled orders

b. Product return

c. The difference amount after the delivery of the order, in case the final total amount of the invoice falls less than the actual amount paid.

4.2 Refunds will be initiated by Gulf Fruit within 2 working days.

4.3 The customers shall normally receive their refunds from the Payment Gateway provider within in 10 to 14 working days depending on their mode of payment.

4.5 Refunds for orders placed through cash on delivery transactions, the User has the option to receive the refund in the Gulf Fruit Wallet.

4.6 Gulf Fruit will not be responsible for any delay of refund payments from the respective bank of the customer as this is beyond our control. In such a situation, the customer shall directly deal with their bank for availing the refund and Gulf Fruit will support the customer by providing all necessary information required by the customer’s bank.

Return of the products should be done at the time of delivery if due to some reason they are not satisfied with the quality or freshness of the product. We will take the returned product back with us and issue a credit note for the value of the return products which will be credited to your account on the Site. This can be used to pay your subsequent shopping bills.



5. LIMITATION OF LIABILITY

5.1 Gulf Fruit shall not be liable, whether directly or indirectly, to any injury, damage or loss for any defect for product or fitness for uses whatsoever in an event of any incident.

5.2 In case of any form of a delivery discrepancy, Gulf Fruit is liable to not more than the amount of the value of the product.



6. INTELLECTUAL PROPERTY

Any elements of text, graphics, photos, designs, trademarks, logos, concepts, branding or other artwork furnished shall at all times be the property of Gulf Fruit or belonging to the respective brand/product, and that unless and until written permission has been given.



7. REGISTRATION

To register with Gulf Fruit you must be over eighteen years of age or, if you are a business, you must be operated by a person over eighteen years of age. You must ensure that the details provided by you on registration or at any time are correct and complete. Customers shall provide Gulf Fruit with complete and updated personal information, which includes the Customer’s legal name, address telephone and e-mail address. The Customer shall be responsible for updating his/her personal information so as to allow accurate and timely processing of the order. User will also be asked to enter a set of passwords that is uniquely for the site. The email address /phone number and password is to be used for subsequence log-in and it is the Customer’s sole and unqualified responsibility to ensure that the email address and its password for the site are kept strictly confidential to prevent unauthorized use. If you know or suspect that someone else knows your password you should notify us by contacting us immediately. We would also suggest that you also change your password immediately through my account section of the website. If the Gulf Fruit team has reason to believe that there is likely to be a breach of security or misuse of the Gulf Fruit website, we may require you to change your password or we may suspend or cancel your account.



8. YOU AGREE AND CONFIRM

8.1 That in the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address or any other wrong information) any extra cost incurred by Gulf Fruit for redelivery shall be claimed from you.

8.2 That you will use the services provided by the Site, its affiliates, consultants and contracted companies, for lawful purposes only and comply with all applicable laws and regulations while using and transacting on the Site.

8.3 You will provide authentic and true information in all instances where such information is requested of you. Gulf Fruit reserves the right to confirm and validate the information and other details provided by you at any point of time. If upon confirmation your details are found not to be true (wholly or partly), it has the right in its sole discretion to reject the registration and debar you from using the Services and / or other affiliated websites without prior intimation whatsoever.

8.4 You authorize Gulf Fruit to contact you for any transactional purposes related to your order/account.

8.5 That you are accessing the services available on this Site and transacting at your sole risk and are using your best and prudent judgment before entering into any transaction through this Site.

8.6 That the address at which delivery of the product ordered by you is to be made will be correct and proper in all respects.

8.7 That before placing an order you will check the product description carefully. By placing an order for a product you agree to be bound by the conditions of sale included in the item's description.



9. PLACING ORDER AND CANCELLATION



9.1 ORDER PLACEMENT

Each product for which you click ‘Add’ is added to ‘My cart’ facility. You are given the opportunity to review the quantity and frequency of order in your Dashboard when you choose to ‘check out’. You can change these, or cancel the purchase of each of the products completely, at this stage, at any time before clicking ‘place order’. After you have clicked ‘place order’ and after our acceptance of your order, items are added to your delivery. You can view your order details by clicking on ‘my dashboard’ whenever you are logged in. Your submission of an order amounts to an offer to enter a contract to buy the products from us, after that you cannot cancel your order. Order is accepted from you until our website displays an order confirmation message. This message is displayed after you click ‘place order’ located at bottom of the page. When you order by telephone, your order will be accepted (or rejected, as the case may be) verbally by our staff. A contract for our sale of products to you arises on our acceptance of your order. Where we accept an order, we do all that we can to ensure that your order is fulfilled.

Products are, however, subject to availability and market conditions and we do not always know if a product is or will be available at the time of accepting an order. If we are unable to deliver an item you have ordered, we may offer a reasonable substitute. You may reject that substitute, and you will not be charged for it or if you have already paid. If we do not offer a substitute, we will remove the product from your order so that you are not charged or if you have paid already, we will refund you the price. We will, however, bear no liability for unavailability of products. The price that we charge you for the products will be the price stated by us on the website prior to you clicking the ‘place order’ button. All products offered by us are subject to seasonal changes in supply levels and market prices. If you are a ‘subscription’ customer (e.g. where you choose to have repeat orders of products) the prices for certain products may therefore differ from the price for those products when first ordered by you. The prices for all products ordered on a subscription basis shall be those prices for the products stated on our website. We recommend that you check the website regularly. The website still allows you to review all the products (and their prices) that you have already ordered from us, and make amendments and corrections to them.

Some of our products are priced by weight (for example, watermelon, and papaya). We show the prices for weights on the website. The guide weight is for guidance only; the weight you receive may vary from this guide and the price you are charged will be for the weight of product delivered.

Ordering a product from us carries with it the obligation to pay for it unless we receive a cancellation from you. 

We sell only to end users and our products are not for re-sale. You warrant that you shall not re-sell any of the products.



9.2 CANCELLATION

Confirmed order's, you will be able to cancel your order by sending an email to https://online@gulffruits.com/ with the reference number of your order and reason of the cancellation.

You could also contact our customer relation team at our business hours (9.00AM to 6.00PM All Day) through our online chat support to request the order cancellation.

Typically, we obtain some of the products especially to fulfill your order and may not be able to sell the products elsewhere. Any payments you have made for orders which have been properly cancelled will be return to you. 



10. DELIVERY OF PRODUCTS AND INSPECTION BY YOU

We will make delivery to your address as stated when you set up an account or update that address. We reserve the right not to deliver to all locations. You are responsible for making suitable arrangements to receive your delivery and giving us appropriate instructions. In the event that your delivery is stolen from your doorstep or from security guards or damaged while there, we do not accept liability. We reserve the right to refuse to accept orders from any customer; considerations of delivery problems may give rise to such a refusal. Any changes to address details must be made before placing the order.



We endeavor to keep your delivery time the same you mentioned while placing your order, but we reserve the right to change it temporarily or permanently.

If we are unable to deliver to you or have to deliver late, for reasons beyond our control, for example, adverse weather conditions, strike / ‘band’ actions, vehicle breakdown, traffic congestion or supplier failure, lockdown restrictions. we cannot accept liability for any inconvenience or loss that this causes. We will not charge for Products unless or until we have delivered them to you.

You must inspect the products as soon as possible after delivery and notify us promptly if you find any defects.



11. PRODUCT IMAGES

All images are for illustration purposes only. Due to the nature of fresh products, the availability of some products and their country of origin may change regularly and with little notice. Therefore images may sometimes not reflect the exact product that will be available at any specific time.
